Alberta Rental Agreement Extension

The lease or “lease renewal” allows a landlord and tenant to renew a tenancy agreement beyond its end date. The other terms of the lease remain unchanged, unless they are amended accordingly. Depending on economic conditions, the landlord can increase the monthly rent. The landlord or tenant is not obliged to resign to end a temporary rent. It is polite that the landlord or tenant should make a reminder before the end of the tenancy agreement. A temporary rent ends on the day set in the tenancy agreement, unless both parties agree to an early termination. For example, if the fixed term is from January 1 to December 31, the lease automatically expires on December 31. Unless the tenant and landlord make other arrangements, the tenant must move by noon on December 31. To terminate a periodic tenancy agreement, the landlord and tenant must inform the other party in writing. The property owner or manager sends the endorsement to the tenant. The endorsement will be added to the lease agreement, which is currently in effect with changes such as the extension period and the new rent amount.

Unless further change, the remaining portion of the lease remains intact. The tenancy agreement is a contract between the landlord and the tenant before the tenant arrives. The agreement can be written, oral or tacit, but the written word is always better because it provides evidence if there is a problem. Major renovations do not include painting, flooring replacement or routine maintenance. A tenancy agreement cannot deprive the tenant of the rights described in the Residential Tenancies Act (RTA).

The Housing Rent Act assumes that a tenant will move at the end of the lease. The lessor is not required to grant a written termination to the tenant.
